Terms of use

The German and English versions of this text are binding.

Scope

These terms apply to the use of Mosque-Search — the website mosque-search.com, the installed web app and the Mosque-Search apps — which Armin Sahinovic, a private individual in Switzerland, operates free of charge and non-commercially (see the legal notice). How we process personal data is described in the privacy policy.

The service

Mosque-Search is a directory of mosques, prayer times and events. Listings come partly from OpenStreetMap and partly from mosques and users. Unless a mosque has entered its own times, prayer times are calculated from the location and marked as calculated. We do not guarantee that listings, prayer times or events are correct, complete or up to date; please check important details with the mosque. We may change, restrict or discontinue functions.

Accounts

An account is needed to register for events, report problems, suggest or claim mosques and sync favourites between devices. You must be at least 18 years old, give truthful details and keep your password secret. Each account is for one person. You can delete your account at any time in your account under “Data & privacy”.

Your content and conduct

You are responsible for what you submit (for example suggestions, reports, claims, and as a mosque manager descriptions, prayer times, events and images). Content must be lawful and accurate. In particular, it is not allowed to:

  • publish illegal content, hate speech, insults or threats;
  • publish personal data of others without a legal basis;
  • submit false listings, events or claims, or impersonate a mosque or a person;
  • send spam or advertising, or attack or overload the service or use it in an automated way beyond normal use.

You keep your rights to your content. You grant us a free, non-exclusive, worldwide licence, limited to the time the content is on the service, to store, display, adapt the format of, translate and make it publicly available as part of Mosque-Search, including pages for search engines.

Claims and mosque managers

Only people authorised to act for a mosque (for example the imam, a board member or an administrator) may claim its listing. You upload a proof document; our moderators check it and inform you of their decision by e-mail. Proof documents are deleted by a daily cleanup once 90 days have passed since the decision. Approved managers may edit the listing, prayer times and events. We may withdraw management rights if they are misused or no longer justified.

Content moderation

We check content when we receive a notice or when moderators notice a problem. Possible measures are:

  • hiding or deleting listings, events or other content;
  • rejecting suggestions and claims;
  • withdrawing management rights;
  • blocking accounts, for serious or repeated violations.

Decisions are made by people with the role moderator or platform administrator, diligently, objectively and proportionately, with due regard to fundamental rights such as freedom of expression and freedom of religion. Automated tools only limit the number of requests (for example sign-in attempts or reports per hour) and check form entries; they do not decide about content.

Reporting illegal content (Art. 16 DSA)

Anyone can notify us of content they consider illegal: signed-in users with “Report incorrect data” on the listing, everyone with the contact form (category “Legal notice / DSA report”) or by e-mail to info@mosque-search.com. Please include:

  • a sufficiently substantiated explanation why the content is illegal;
  • the exact web address (URL) of the content;
  • your name and e-mail address (not required for notices about child sexual abuse material);
  • a statement that you believe in good faith that the information in the notice is accurate and complete.

The report form shows a confirmation as soon as we have received your report. For notices by contact form or e-mail we confirm receipt by e-mail and inform you of our decision and the available remedies. We handle notices in a timely, diligent, non-arbitrary and objective manner.

Statement of reasons (Art. 17 DSA)

If we restrict content you provided or your account, we inform you by e-mail at the latest when the restriction takes effect: what we did and for how long, the facts and whether we acted on a notice or on our own initiative, the legal or contractual ground, whether automated means were used, and how you can challenge the decision.

Complaints and remedies

You can object to a decision on a notice or a restriction within six months by replying to our e-mail or writing to info@mosque-search.com. A person reviews the complaint and we inform you of the result without undue delay. You can also turn to an out-of-court dispute settlement body certified under Art. 21 DSA or to the courts.

Threats to life or safety (Art. 18 DSA)

If we become aware of information giving rise to a suspicion that a criminal offence involving a threat to the life or safety of a person has taken place, is taking place or is likely to take place, we promptly inform the competent law enforcement or judicial authorities.

Status under the Digital Services Act

Mosque-Search is a hosting service and, where content is made public, an online platform. Where we qualify as a micro or small enterprise, the additional obligations of Art. 20 to 28 DSA do not apply (Art. 19 DSA); on request we provide the competent Digital Services Coordinator and the European Commission with the average number of monthly active recipients (Art. 24(3) DSA). Points of contact: imprint.

Open data and licences

Data from OpenStreetMap is © OpenStreetMap contributors and available under the Open Database License (ODbL). Where our directory contains OpenStreetMap data, that part and our changes to it form a derivative database that is available under the ODbL on request. Place names come from GeoNames (CC BY 4.0). Details: About Mosque-Search.

Liability

Mosque-Search is free of charge. We are liable without limitation for intent and gross negligence, for injury to life, body or health, and where mandatory law provides for liability. Otherwise we are not liable, in particular not for the accuracy of listings, prayer times and events, nor for content of linked websites.

Ending the use

You can stop using Mosque-Search and delete your account at any time. We may block accounts for serious or repeated violations of these terms, after informing you with reasons as described above.

Changes to these terms

We may change these terms for the future, for example when functions or the law change. We inform registered users by e-mail or in the app in good time before changes take effect; if you do not agree, you can delete your account.

Governing law

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you have your habitual residence.

Consumer dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
